This website is owned and operated by Asha Noel-Hart ("I," "me," or "my"), based in New Brunswick, Canada. By visiting this website or purchasing any product or service offered through it, you ("you" or "your") agree to these Terms of Use. We reserve the right to update these Terms from time to time. Changes will be reflected by an updated effective date. Continued use of the website after a change means you've accepted the updated Terms.
2. What This Website Offers
This is primarily an online business offering business operations and systems support. Through this website, we may offer digital products (guides, templates, frameworks, and other downloadable resources), live and recorded events (workshops, group sessions, and learning experiences), and direct consulting services (one-on-one strategy work, fractional support, and advisory engagements). Offerings may change over time as the work evolves. What's here today reflects where we are now.
3. Pricing and Payments
For Services, fees for Canadian clients are listed in Canadian Dollars (CAD) plus applicable taxes. For International clients, fees are listed in US Dollars (USD). Event and Digital product fees are listed in USD unless otherwise specified. All fees are subject to change without notice.
Payments are processed securely through third-party payment processors. We do not store your payment details. Please review the privacy practices of those platforms directly.
4. Payments, Refund, Cancellation and Chargeback Policy
Digital products: Due to the immediate nature of digital delivery, all sales of digital products are final. If you experience a technical issue with your purchase, please reach out, and we'll do everything we can to make it right.
Events: Unless specified on the registration page for an event (workshops/retreats), all events are non-refundable.
Services: Payment terms and cancellation policies for services and consulting engagements are outlined in your service agreement before any work begins. Generally, deposits are non-refundable once work has commenced. If you need to reschedule a session, please provide at least 48 hours' notice.
If something unexpected comes up on your end, please reach out. We believe in working things out with care and will do our best to accommodate when possible on a case-by-case basis.
Chargebacks: Before initiating a chargeback, you agree to contact us and allow fourteen (14) days to attempt resolution. If a chargeback is initiated without prior contact, we reserve the right to revoke access to Services and provide evidence of your purchase and usage to the payment processor. We also reserve the right to pursue recovery of funds, including associated costs and fees, in the case of a wrongful chargeback.
Payment Authorization: If you select a payment plan or recurring payment option, you authorize us to charge your selected payment method on an ongoing basis until all payments are completed. You are responsible for ensuring your payment information remains current and valid. You are responsible for managing, updating, or cancelling your subscription in accordance with the stated terms. Any changes or cancellations must be made at least twenty-four (24) hours prior to the next billing cycle unless otherwise specified.
5. Intellectual Property
All content on this website, including writing, frameworks, design, images, course materials, and any other original work, belongs to us unless otherwise stated. It is protected under Canadian copyright law.
When you purchase a product or service, we are granting you a limited, non-transferable license for your personal or internal business use only. You may not share, sell, or redistribute these materials as your own without our express written permission.

15. Disputes and Claims
You agree to attempt to resolve any dispute or claim by first providing us with written notice at connect@ashanoelhart.com that includes a detailed description of the nature of the dispute, the Site pages or Services affected, and any other information reasonably necessary to understand and evaluate the claim. We shall have ninety (90) days from receipt of your notice to respond and attempt to resolve the matter before any formal proceedings are initiated.
Time Limitation: Any claim must be brought within two (2) years from the date the cause of action arises, unless a longer period is required by applicable law.
